hmm still need some thoughts/help, but in hopes to quell my overheating issues, which i think is the case i have under clocked my cpu buy 100mhz and lowered the voltage down to 1.2, bios for oc looks like thiss 200x8.5 voltage at 1.2 i hope this helps

Can you post a photo or two of your case's innards? You may have really poor airflow inside your case.

an update for this as well i read on the forums that Everest Ultimate was a good temp reader, so i went and got it, my idle temps are 37/38 and under load 44/46 the temps while gaming have droped drastically since i undervolted the processor, i think it may have been getting too much juice, i have voltage at 1.2 right now is there any suggestions for a good voltage for operton 165s

No real standard answer vis-a-vis voltage. Some chips can stay stable on really low voltage (i.e., for K8 939s such as you Opteron, 1.28-1.32V), and many require really high volts (1.45V and above).

The only way to know for your specific chip is to subject it to testing.

Sorry for a non-specific answer, but this has been dictated by my experience with many of these chips.

txtmstrjoe i thank you for you help and suggestions, its given me what i need to fix this problem. I have the opty running at 1.2 volts on stock 9x200 played a good 4 hours straight of cod4 and my processor temps hardly moved off idle. I know the temps could be better as im finding out more and more that the butterfly isnt the greatest heatsink in the world. but im stable at last, and since i added another intake fan my computer has been running amazingly well.

on a side note i even over clocked it with under voltage and it stayed stable until i pushed it to hard (8 processor heavy programs at once) so i may try a slight overclock just to bring me up to 2gig per core.
