Anyway it sounds like a heat issue to me but I want to make sure.

Do you have a program called Riva Tuner? If not download it from here

I don't mean to offend you with my instructions below. I'm just operating under the assumption that you've never used RivaTuner so I want to be thorough.

1. open RivaTuner and click the circled button in the pic below

2. click the circled button in the pic below

3. a window will open showing 4 graphs. One of which is Core Temperature(circled).

4. Leave RivaTuner open and start COD4. Play until you experience choppiness. Once you do quit COD4 and look at the graph for Core Temperature. Mouse over the highest point and post the temp.
yeah i have rivatuner i used it to set clock speed and turn my fan speed up. i also have a pink counter from rivatuner at the top left of my screen when im in-game, which tells the temperature. the highest it's ever been was 84 degrees and that was with fan at low, it has never gone above 70 with the fan speed high, and i still experience choppiness no matter what temperature its at, usually playing cod4 its around 65 degrees.

monitor your cpu temps with speedfan or a similar program, if your cpu temps oscillate a lot while playing a game then you might find the problem.. that is how I solved my busted cpu mystery

"CPU" stays the same almost always, increased 1 degree after like 10 minutes
"Core 0" changed a degree every 5 seconds or so
"Core 1" changed a degree every 5 seconds or so
