You see, this is a bit problematic. I'll just give you a funny illustration of something that I could envision happening...

Being a software engineer, I can vouch that I have seen some very funny ways of assigning extensions to files. Sometimes for a reason, sometimes just for kicks (yes, it's not a very fun job) we may assign an extension AVI to a file that has nothing to do with a video AVI file. Now imagine I was working on some project where I had a bunch of these files and I wanted to make them accessible via my shared folder. Now imagine MPAA for some reason scans my machine at the same time and says I was sharing copyright AVI files? You see the problem?

Saying that you were sharing because you had a shared folder with some files in it is not enough. Saying that you were sharing because you had a shared folder with some files in it that can be confirmed to have been accessed at least once and are in fact copyright files can be enough.

That is illegal and you can fight that if they find anything. They cannot search without probable cause. (exceptions are made while on school ground, government building, etc)

Yeah, I'd agree with the cop there under most cases. If you're sweating crazily and you got pulled over for doing 10 over, something is up.

Unfortunately there is still a lot of racial profiling done by cops. That is definitely not grounds for a search, and could also be fought in court.

This is considered intimidation and searches based on intimidation are always thrown out of court (I have direct experience with this).

Again, so long as you obey the officer, they can do nothing. Stepping out of the vehicle is NOT permission to search. (however... that feathered roach clip hanging from your rear view mirror IS probable cause since it is considered drug paraphernalia IF it has been used for such. If it is clean, they can only give you a ticket for obstructing the view.)


This has happened a lot and one of the local anti-illegal search proponents answered like this:

Officer: You were speeding, heres your ticket, may I search your vehicle?
Driver: Only if you have a warrant.
Officer: If you have nothing to hide why do I need a warrant?
Driver: May I search you first so you don't plant anything in my vehicle?
Officer: No Sir.
Driver: If you have nothing to hide.....

I have in-laws in law enforcement (from the local reserves to the FBI (narcotics division)) and without exception they always say NEVER EVER let anyone search your property without a warrant. "."


If you say no and they do search your vehicle/house/horse, anything they find will be inadmissible in any court.

but back with the having files "availble" on ur computer. these files have real life, actual, physical counterparts n the form of cd's and dvd's (and whatever other format u can think of). so if u leave cd's on ur front porch n the form a white trash wind chime, for example, then u'd b breakin the law according 2 these fools.

how about stores having all these cd's and dvd's out on the shelves... that's exactly like having them on a computer n a shared folder.

ppl go n2 a store and look at songs they want - ppl go n ur computer and look at songs they want

it's only a crime once u've committed an act like taking the cd and putting it n ur purse or downloading it from the computer.

they're just trying 2 make more and more laws that favor the industry and their money.
