No it isn't! The only reason retailers don't sell used PC games is because they cannot guarantee the original user didn't disable the key or hasn't kept the key. That is the only reason!

Like I said, you are just clutching at straws. You are allowed to sell the license to something, that is all you are doing with PC games. It is the users choice if they want to buy an item used or new......nothing of the sort is stealing.

You need to define OS. There is a difference between retail, academic and OEM. All of them have different rules about resale. You are allowed to sell retail copies of vista, for example, up to 3 times (iirc) while you are never allowed to sell an OEM or academic 2nd hand.

Ignore PC games and concentrate on console games. Being from England you'll know as well as me big retailers won't touch PC games. But console games, they will.

It's effectively the same as piracy. Only one copy is sold and the developer is paid once, on either scale.

It's just as responsible for loss of profits, if you ask me.

No, you are confusing 2 seperate things as they happen to have an effect in common. Just because both instances, pirating and private game sales stop the creator from making money on the transfer, that does not mean that they are both illegal or the same throughout.

I can see were you are coming from, yes it is a loss of profits. But someone did make a profit.....you have the right to sell your own property...even though the intellectual property remains that of the producer, the hard back copy is yours to do as you wish.

If I buy some towels and only use them once. Is it illegal to sell them to my sister because they match the colour of her bathroom

this concept can be applied to anything but you are missing the fact that it was purchased legally and the company still made a profit from that particular item in question, the company really doesn't care about that product after that (Hence why Crytek pulled support )

I'm striking up debate over this non-issue. I understand fully licencing laws and my rights as a licence holder. I agree to the hilt that I should be able to trade games in.

And as I said in the first post, EA and a few other publishers were pushing to make trading games illegal not too long ago.

Ah, yes, but they've also made a profit from the copy the pirate bought legally. Except the pirate distributes the software for free, whereas retailers distribute it for money. The retailers could make a killing.





I know there's a massive difference between 8000 people downloading Andy McKee from one original and retailers selling pre-owned games. But the link is there and it's worth chatting about =D

Hmm, not sure how I have a superior tone when I am using the same font as you I was just trying to point out that, yes there are some similarities, but it is the differences that make the case.
