Just to understand, are you on high speed, or Xtreme? If high speed, that's normal. Unfortuantely shaw has this mandate of "maximum of...." or similar. Carefully worded, so that if you wanted 5mb, you'll usually get 4.25-5mb on average. With Xtreme, 8-10mb, with occasional speedboost spike to 25mb .

The speed tests you ran, are accurate, except for the upload glitch, I had that to.

Try this, check your dl rates, if you are hardwired to the router, (not wireless), and do this after a few hours having the modem turned on. And also, check the "ends" of the coax cables for any pin's damaged, scratched, broken, or to short.

I had a super short coax cable PIN, and it made my internet lag... such a small little thing lagged my connection.
