Ah. I guess I misunderstood. But the ones on top will never get caught. The distribution network for Piracy, the reason why Napster *original* was so successful, had been in place long before P2P had even been prominent. Back when computers were first mainstream and in houses, geeks would meet up to swap programs, free at the time, as compatibility issues were prominent and there was no easy method of distribution. These evolved into what was the beginnings of today's software distribution systems. They are the ones who introduce the programs into the P2P channels which are then replicated endlessly into so many forms and repacked like crazy. I am not sure how much you know about current piracy groups but now much of it is centered around Scene releases, which are releases made by prominent software cracking groups. Some you may have heard of before are Reloaded, Razor1911, Vitality, etc. They create the files, crack the exe's, etc, and then they let them out into the P2P networks and someone copies them onto torrents, html-based filesharing, Usenet, IRC, Gnutella networks, etc, and are repacked, duplicated under different names, they have viruses added, etc. The initial scene releases will most likely never be affect by the RIAA as they are too high up and are not public enough but the ones who say host a torrent of the latest game on The Pirate Bay will. And yes it is a shame but even the scene groups say that if you enjoy the game that you should buy it although for the ones whom the games trickle down too on, say Limewire or uTorrent, this is not relevant. I do not believe the ones whom you were referring to, I believe the Scene groups, will ever get sued, but I personally believe the problem lies with the mentality of the average users and not these guys although they are definitely part of the problem.

Yes but it clearly is not accidental when it becomes abused by so many. It's illegal and it also seriously hurts the industry, gaming music and movies, and thus the RIAA is forced to take action.

Theres no way Honda Motors can sue me because they ONLY want the original owner to drive said car. When you physically give away something, it's actually "giving". However, the problem with this is that you don't lose anything when you give away, and you can keep "giving away" indefinitely - if you give your Accord to your daughter, Honda *may* have lost one sale, but when you share an mp3, the copyright holder may lose hundreds, thousands, or millions of sales. If you could just photocopy Accords at no cost and gave the copies away, Honda would lose significant amount of sales and therefore money, and would be at your back in no time with a million lawsuits.

Having said that, I still feel like razing RIAA headquarters.
