You should have read the rules, a lot of companies don't accept RMA's from ebay sellers because you may have bought the board broken. I was in the same position with my old 8800gts 320mb, luckily the XFX rep turned up on OCN and helped me out.

But, you'll either have to do a lot of bargaining or pay a small fee for them to accept it. Oh, and learn a lesson!

Is the MB acting up with the old CPU too? If not, perhaps a BIOS update is in order.
If its screwy with both, perhaps a paypal claim is then in order... or... the RMA.
