[PCW] Microsoft wins "Vista Capable" case

A federal judge Wednesday stripped class-action status from the "Vista Capable" lawsuit that has plagued Microsoft Corp. for nearly two years, but will allow the plaintiffs to continue to sue the company separately.

The split decision does not put an end to the lawsuit, but it will make it much more difficult for consumers to press their cases.

Not surprisingly, Microsoft applauded the news. "We're pleased that the court granted our motion to decertify the class, leaving only the claims of six individuals," said Microsoft spokesman David Bowermaster in an e-mail late Wednesday. "We look forward to presenting our case to the jury, should the plaintiffs elect to pursue their individual claims."

I feel bad for MSFT. Their Vista was misleading - But it was something new and naturally will have problems. Hopefully they wont have such a problem with Win7.

This is what happens when people sue companies who clearly stated limitations. M$ said that the class of vista it was capable of was downgraded. They said it was capable of running Vista BASIC which cannot run Aero. The limitation was based on a limitation in hardware which made the computer unable to run the Aero subsystem, and it was clearly stated. The people got butthurt and sued, and the lawsuit was frivolous. I'm glad the court stripped the class action from it. Their cases wont hold nearly as much clout as individuals.

Vista capable means running Vista.


Even if that Vista is the bastardized Home Basic...it's still Vista. I think.


Besides, it doesn't take much to ace Vista. Look at my sigrig.

I think the mass-population (i.e the people who don't visit this site ) probably don't even know what a OS is. They just think, heyyyyy Vista Buisness is probably what I need or hey! Home Premium looks sweet on my neighbors computer. What they didn't know is the computer they bought 3 years ago at Best Buy couldn't run all the features the other Vista's had. Plus the bloatware they get from the store bought PC and they have no idea what is bogging their system down. I don't think thier lawsuit had any validity to it since the systems were marked "Vista Capable" and that's just a general term which meant it could run basic, but maybe not more.

My opinion is the suit should've been to force Microsoft's hand to advertise better which machines could run which version. Just simply saying "If the computer you are buying doesnt have a dedicated video card, then don't expect to run anything other than Vista Basic" would've cleared up many problems, but then again people would've stuck with Windows Xp and how could MS make any money
