I think what he's saying is that it's against TOS should you get caught. If one reads their TOS, it's not as grey as we would like it to appear. While I have 3rd party hdd in both my xbox, I suppose if I were dumb enough to admit to MS that I'm using unofficial hardware to access live according to their terms of agreement...they can ban me for that, as well as for external modifications (if I had any.)
