This is correct. The license key means you are entitled the right to a guaranteed copy of the media, regardless of where you get it from. They obviously don't say that because they don't want people to get viruses and all kinds of malware from non-genuine copies. But it is completely legal to acquire the genuine unmodded copy from anywhere it is made available if you own the license for it.

Well you are half right. It is illegal for them to share it to begin with if they don't own the license but it is completely legal for you to download it if you own the license. You are entitled to a copy of the media, regardless where you get it from. The only person that could face charges in this scenario would be the unowned seeder.
This is not correct at all. It is still illegal for you to download the torrent unless YOU uploaded your disk for your own personal use to download again. You are not entitled to download media you already own. Additionally, the torrents usually contain a crack which would be illegal to download anyways, even if downloading the disk was legal.

I apologize I guess I must have been misinformed. What I stated above is exact what a Microsoft member I contacted told me. He said that legally, for whatever reason should you no longer be able to own the media, you are entitled to a single copy of this same exact media. He literally stated: "Where you choose to get it from is irrelevant".

What it boils down to is that you can borrow the disk from anyone legally, that is what your "supposed" to do. What the rep was probably trying to say was that MS does not actively persue legal action against people who download over torrents (I've never heard of a MS trying that).

Let me take a second to explain why this is, as it seems like an odd law; Imagine you bought "tony hawk's underground" for the PlayStation, and lets assume there is no copy protection so nothing else illegal has been added. You break your disk, so you go online and download the "Tony Hawk Underground PlayStation" torrent, burn it and slap it in. You play the game for awhile, then notice there are some new levels, as you have inadvertently downloaded the "collectors edition" which would have cost $60 instead of $40. You have now committed piracy, because you did not pay for the collectors edition. This case of course could be less petty with enterprise-level software. The law is actually in place to protect you from inadvertently breaking it, and to protect the companies in court when the pirate tries to claim they were just trying to replace a broken disk.
