Hmm..Turn off AMD Cool N Quiet in the BIOS if enabled, and update your BIOS! Is the board running the latest revision BIOS? I smell a BIOS update is in order.

If you truly set your CPU multiplier to 12X and it stuck, then you do in fact have an engineering sample. The highest multiplier available on a 3700 is 11X, not 12X and the stock speed is 2.2 ghz, not 2.4 ghz.

You wouldn't use it. Most don't even use the 11X and that's the reason that a 4000 just doesn't make any sense if you're going to OC. The nice thing about an Engineer Sample isn't the unlocked multipliers. The nice thing about them is that they're usually the pick of the litter.

Are you sure you didn't get a mobile chip? did it have a heatspreader on top of the CPU?

My Newark 3700 mobile is the same top multi is 12x, sounds like a bios issue.

I've just flashed the bios to the latest version on the asrock website and everything is still the same. Also in reply to sccr64472 I've just checked on amd's website and the 3700 Clawhammer Soc754 runs at 2.4ghz with 1mb of L2 cache. I have also noticed in the cpu setup section of the bios that the multiplier and fsb maximums are showing as 25x and 5000mhz.

As several have said... if the BIOS does not have the data to recognize it it may come up as an ES! Jori's 2800+ 754 did untill I updated the BIOS!
The only time I ever go an ES was direct from AMD on a RMA of a 2100+ TB long ago.
