It would make an interesting argument; especially if the purchase date of the dvd was not known (although I don't support piracy, I had given this some thought previously).

The defendant could claim that they merely used the downloaded copy as a "backup" to avoid breaking the DMCA. At this point, the opposing side would likely say that "someone" had to break the DCMA in order to post the content. The counterargument would be that the defendant could not prove nor disprove the guilt or innocence of the content uploader and deemed the content uploader innocent until proven guilty. If the uploader was innocent, then the defendant could receive a backup copy that didn't violate the DCMA.

I would like to know how they could prove that it was any one person that downloaded it.


If I have a wireless router which does not have an WEP on it and someone jacks my internet service and downloads a movie. wouldn't it still show my ISP as the download location?

I have not seen this movie, and do not use Bittorrent, but I have downloaded movies that I own but have been unable to put on my media server (scratched disc for example), so I would be interested in how said argument would turn out in this case.

I feel 100% justified in having my media available to me from whatever device I choose via my media server, while the DVDs themselves rest nicely on the shelf.
