Thanks man, and im sorry for not listing evereything here also. that is what i get at a pc help forum lol. funny thing was they wanted me to run dmc4 and sf4 benchmarks, but sf4 had trouble downloading. Everytime i downloaded the .exe when it finished downloading it turned into a file(description when you right clicked and properties). so i just ran the dmc4 and even on a pny that im not sure is running at 100% it still was outperformed by 20-50FPS.

I know for ATI cards there is a way to flash the BIOS on the GPU. Is there any method like that for nVidia cards? That's the only thing I can think of if its not a driver issue. Re-flash the BIOS to see if anything changes. If not then most likely card will need to be replaced.

Whats the current BIOS version read as in GPU-Z? Here is a thread at nvforums with 3 links to 3 BIOS versions for the GTX 275 for XFX:

http://forums.nvidia.com/index.php?showtopic=168856

Maybe try NVflash with the BIOS that matches your current BIOS and see if that fixes it.

Hopefully you have a better experience if sending the card back. I didn't have to send mine in. I just needed a stock cooler replacement so they sent one out right away. Of course FedEx stuck it to me stating signature was required. On the 3rd delivery attemp I had left a note on the door with my signature stating they could leave the package on the porch. The delivery guy left yet another door tag, X'ing the signature required field and circled it.

Thankfully enough, I informed XFX and they are just going to ship another cooler ensuring that FedEx is aware that no signature is required.
