I'm pretty sure the black edition was refreshed but if not, AFTERBURNER still has the settings in it's options, even if the card does not allow for it to be changed.

Thanks everyone for the help, I did as the previous member told me, registered. Flashed bios and all is well. This card is fantastic and im sure it should last a long time, If need be, I could always add a 5870 for tri-fire..woot

well that is true, but what is the point, both 5970's I have had have the old bios and everything in afterburner is grayed out.

I'm just a little hesitant because I bricked the first one trying to flash it and the one I got back was DOA so I am getting the AC 5970 extreme so I can just enjoy the damn thing.
