StarWars BattleFront 1/2 Question

Hello.
Recently I went and updated my BattleFront II making it impossible to play with since they have protection against CD Images on a higher scale.

I check to find that someone has intentionaly scracthed the crap out of my first disc with the others intact. Now I got realy relay pissed cause no one is doing crap about it and now Im taking the money from my brothers since they aint going to admit it or pay for it.

Second before on Battlefront 1 they literaly cut the disc like it was pie or something now it wasnt even my copy it was my friend's and this was when they both came out.

Now here I want to mail the CDs to Lucasarts for replacments of $5 I realy dont know how it works; has anyone ever tried it before ?

Here is what it says in the "license" text in the game folder:

LUCASARTS DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED. LUCASARTS SHALL ALSO NOT BE LIABLE FOR ANY DELAYS, SYSTEM FAILURES OR SYSTEM OUTAGES WHICH MAY, AFFECT ONLINE GAME PLAY OR ACCESS THERETO. LUCASARTS RESERVES THE RIGHT TO DISCONTINUE MAKING THE SERVER AVAILABLE (AND YOUR ABILITY TO PLAY THE GAME) AT ANY TIME AND FOR ANY REASON.THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU, AND YOU (AND NOT LUCASARTS) ASSUME THE ENTIRE COST OF ALL SERVICING, REPAIR AND/OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
That was about the game breaking and such.
Heres the other part which game before the quote above:

LucasArts warrants to the original consumer purchaser only that the media furnished in this Software will be free from defects in materials and workmanship under normal use for a period of ninety (90) days from the date of purchase (as evidenced by your receipt). If the media furnished in this Software proves to be defective, and provided that the original consumer purchaser returns the media to LucasArts in accordance with the instructions in this paragraph, LucasArts will replace the defective media: (a) free of charge to the original consumer purchaser, if the media proves to be defective within the ninety (90) day period following the date of purchase, or (b) for a fee of $5.00 (all references herein are to United States dollars) per DVD or Compact Disc ("CD"), if the media proves to be defective after the expiration of the ninety (90) day warranty period, provided that the request is made within a reasonable time from purchase, and LucasArts continues to distribute the DVD or CD commercially. To obtain a replacement DVD or CD, please return the defective DVD or CD only, postage prepaid, to LucasArts, a division of Lucasfilm Entertainment Company Ltd., P.O. Box 29908, San Francisco, CA 94129, accompanied by proof of date of purchase, a description of the defect, and your name and return address, as well as a check for $5.00 per DVD or CD made payable to LucasArts if after expiration of the warranty period. LucasArts will mail a replacement to you. In the event that the Software is no longer available, LucasArts retains the right to substitute a similar product of equal or greater value. This warranty is not applicable and shall be void if the defect has arisen through abuse, mistreatment, neglect, or from normal wear and tear. LucasArts has no obligation to provide support, maintenance, upgrades, modifications or new releases under this Agreement.
Now I need to know, can I send both games even though the 90 day warranty is out and that I can pay a $5 fee for them? I lied to Lucasarts about how the damages happened but not about what they are. And do I have to mail them together or no? If I do; do I seperate the checks or no??

So can I send both or no I need some help here Im very and and I realy want to kick the @$$ out of my brother's who have no absolute feelings for anyone. You will know if its them if they come to these forums saying "Intels are so much better than AMDs" and "My Pentuim 4 at 2.8GHz will outpeform your Sempron overclocked at speeds which I dont know." And the worst part is they said this "Overclocking is for losers" to me and I think they ment you guys. And Battlefront wasnt the only games they destroyed, they destroyed a $120 imported PS1 game of mine which will never work again. Ok sorry for going off topic but please answer my question and you may leave comments too. Thanks

Before you send $5, borrow a SkipDR (not automax) and repair it. Then make a copy using CloneCD (Clone is very good at copying scratched CD's). If the CD is scratched on the label side, sorry man.
The $5 thing isn't going to work. However, try what I posted above, and yes it is legal, since it's for backup and you're not disbruting it.

It is your obligation to make a copy of your CDs when you get them. It is always legal no matter what anyone tells you just as long as you don't give or sell them. The only exception I know of is when you rip a music CD, some have DRMs, you can use some software to get the music only.

The fact is Im not afraid to clean it up at GameCrazy since they do it nicely. But I wont think it will be as effective because of the scratches since they are so deep. But can I send the CDs or no? I already backed up my Battlefront II its just that the new patch made it impossible to play with a Image. So I cant return both for $10? I mean I realy wanted to preserve the game not have it get messed up I just want to keep the copy clean.
