For cooling the cpu i've got Thermaltake Spark+ (http://www.thermaltake.com/2005/coolers/spark/a1715.htm) and I've put Arctic silver 5 before...isn't it too high?

38 on air is fine. What's the load temp get up to?

Μy load temps are around 48 to 50 degrees
If i changed to an aluminium pc case with more funs would i see a lot of diferrence?

What is your setup currently in?

Also, you might want to consiter a new PSU, a value 300w ain't going to get you anywhere in the OCing world.

If OCCT crashes...then is it sure that is the cpu problem? or might be the ram fault?
like prime if it crashes you don't know what's wrong, is it the same with OCCT?
