You can usually tell if it is a reference card or not by the design of the stock cooler. The reference coolers all look the same, save for the sticker on it (if there even are any). Currently, I don't think there are any non-reference GTX 570's on the market, although they most certainly are in the works.
For FPS's, the 570 has no problem playing with high to maxed-out settings in the majority of the games out there today. However, it depends on the resolution you are running at, which will dictate how far the 570 will stretch. Seeing as you are coming from an 8800GT in your sig rig, though, I'm pretty sure you will really appreciate the HUGE increase in performance regardless. The fact that you're only paying ~$70 out of pocket just makes this a phenomenal deal that you should not hesitate to hop on quick!
