Is this covered under XFX Warranty?

Well lets start out with the history of this matter, and a warning.

On November 14th I sold two beautiful, fully functional XFX 8800 GTS 512mb cards to the same seller on eBay. As per my promises, I paid for insurance on my dime, and gave the buyer the codes needed to transfer the warranties. These cards were pristine and completely working, since they came out of my sig rig (ie my main).

A little over a month later the buyer contacts me. Apparently after a month he finally got around to opening the package. He tells me that one of the cards was broken, and that the PCIe connector was damaged. He then goes on to tell me that he knew that it was like this before it was shipped, and that its too bad that I would do something like this.

I of course tell him that the card was not damaged at the time of shipping, and the picture on the eBay ad shows that there is no damage to the PCIe connector. I go on to tell him, that I paid for shipping insurance for this very occasion where the cards are damaged in shipping, and it is his responsibility to collect on the insurance owed to him. If he waited to long, it is not my problem. I also told him that he had the warranty, so he could try to RMA it. Furthermore, I have no guarantee that he did not damage the card himself, and we both can reference the eBay ad picture to see that the card was completely undamaged before shipping.

Of course it went to a eBay dispute and he won straight off with no true moderation on the subject. I then went on to learn that in a dispute, the buyer always wins and that many people on here, even, have been scammed out of expensive parts. The message I'm trying to give you is, don't sell on eBay.

Now the card has been returned to me and upon opening the package, it looks like the buyer let his dog chew on the PCIe connector.

I know this is a long winded post for something I basically already know without asking, but I wanted to spread the word to help fellow OCNers.

Regardless. Do you think this would be covered under XFX warranty?

Unfortunately no, you got scammed by an ebay troll it seems

I'd recontact Paypal and try to appeal the payback, as it is totally off base, however, do this on the telephone, it's more personal, just try to stay calm :\\

Contact Paypal via phone, and see if you cant appeal.


Stuff like this is why I dont use ebay. The company itself is a scam.

Sadly since its an eBay transaction, they won't even talk to me past that point. I tried earlier.

And I had a feeling since its almost impossible for that damage to NOT be user fault.

Sorry to hear about this. I used to buy and sell on eBay all the time.

I just sold my perfect 5850 on the bay due to low reps. I took photos of every single card angle before shipping it today.

BTW, did the serial number match the card you sent him?

If you are in CA I would sue e-bay. I mean their business is to connect buyers and sellers and provide a safe forum for transactions. You allege they failed to provide you with a merchantable product.

Bull**** they wont talk to you past that point. Take a guess at who owns Paypal??? Ebay does. There shouldnt be any problem with them talking to you. If they wont, threaten to complain to the Better Business Bureau and the Attorney General, and if that doesnt work, threaten to sue on <insert legal term with evidence of said claim here>.

This is one of the reasons I don't like ebay, I make sure 100% that the product is working, and when the buyer receives it... it's not working at all... and it's a huge mess trying to convince the buyer to calm down.
