Let the punishment fit the crime.

The thing with the lawsuit is that you can most likely settle for a much more reasonable amount, whereas the criminal record isn't something that can be "settled." I guess it isn't a problem if you are trying to get into a normal profession, though.

All the settlements the RIAA offers are too extreme by themselves.

You get a letter in the mail saying "We caught you DLing songs, send us $5,000 and we won't take you to court -The RIAA"

You stand up for yourself and make them prove their case.

You lose and are ruined.

I never understood that argument.
It isn't as if when you steal from a bank you can just give the money back and say "my bad".

Now, I am not going down the argument about stealing vs. sharing. I am just commenting about the penalty "if" there is agreement that you took something that doesn't belong to you.
Let me tell you what is wrong with what you think. These aren't supposed to be punitive monetary awards, they are supposed to represent actual damages. While no one can say just how many times a shared song has been downloaded, in all of the trials so far it seems that the RIAA has been grossly overcompensated.

In many European countries the amounts are much more realistic, generally no more than the song costs, with awards ranging from $50-200.

OT: i believe the RIAA should be dismantled and all members fined the same amount for what they think people owe. Make them feel like victims also know what i mean ?
