all that can be done in dx9 to make it look that good, using various rendering techniques to achieve it.
The problem lies with dx9, and slightly dx 10. As long as developers code for them, they have to create 2 entirely different rendering builds, as dx 9 and 10 do not support tessellation. The insane amount of work to render both the entire game in tessellation and with old mip maps and such is probably to much work to be worth the costs.
