LOL, I really do hope Apple succeeds. Then I will ROFL while everyone switches to Droid and their stocks face plant. I hope I live to see the day when an over zealous greed monging corporation gets totally powned by the consumers its trying so hard to screw.

You do realize that if Apple gets totally powned as you immaturely claim, that means that competitors will increases prices due to decrease of competition right? Why is it that Apple haters never seem to get the bigger picture? Also, only a MINORITY jailbreak their device, because normal customers don't give a rat's dropping about things like jailbreak or open source and what not. They are perfectly happy using an iPhone in its controlled environment. Do you know why? Because it is a PHONE. Also, if they do successfully fight jailbreaking, it will not affect Apple at all. Jailbroken iPhones in the US are almost always 2nd hand iPhones purchased with an initial contract or paid full price for without a contract. Apple already made their money regardless.

In all fairness, one of the qualms is fair--with the fact that it's trivial to acquire cracked applications with a jailbroken iDevice that, otherwise, you'd have to pay for with a non-jailbroken device. Jailbreaking in and of itself is no biggie really. But when you consider how incredibly, incredibly easy it is to obtain free apps, Apple has a right to defend it's turf. If it wasn't for that they probably wouldn't care...at least not as much. It's amazing that things like apptrackr and hackulous are still up and running. I dont know why Apple doesnt just go after them, the main source of blatantly pirated apps.

I firmly believe that anyone who claims they jailbreak iDevices - particularly anyone that frequents a site like OCN - ONLY for customization reasons is utterly (and completely) full of crap. I don't believe anyone that claims otherwise - ever. I mean it's so easy a caveman could literally do it, it's almost dumb not to if you jailbreak.

Could be a situation where the site is hosted in a different country. Look how long it took to take TPB to court.

I would have thought that modifying the bootloader would only be copyright infringement if you tried to redistribute the modified version. If I tear a page out of a book I am not infringing copyright. But if I do it and then redistribute the modified book I am most certainly infringing copyright, especially if I claim the modified version is mine.

DMCA exceptions aside, I don't see how Apple has any case here.
