As some one said before me he overclocked it which voids all warranty. (to you not necessarily Intel) Also it run fine at stock which is HOW IT SHOULD RUN!! No problem on your part.

It works at stock and he even admits that so I don't see how he could win any kind of dispute.

Simply staying and providing the proof that he admitted to overclocking (as well as stating that he damaged it from overclocking) should guarantee you keep your money.

You should point this out, when you file your claim. Also point out the time he has had to use it and overclock it.

One other thing is you should explain what overclocking is for example "he pushed the CPU above what is recommended by Intel," a lot of people don't know what overclocking is and you should make sure the people at paypal understand.

If he did damage it your only other option is to get a damaged CPU back from him. Explain as simply and clearly as you can what overclocking is, why it is bad and not recommended (post excerpts from Intel's warnings about it), and I think you should have a half decent chance.
Excellent advice. If you mention the OCing (and his admission of it), you have a very good chance at winning your case, despite PayPal's bias toward buyers.

I need to sell a few computer items too and this is exactly why I do not want to use PayPal for any of my transactions. I just signed up for a third party approved payment method . There's MoneyBookers, ProPay, and Paymate. I'm lucky I haven't been screwed over yet by any PayPal buyers when selling items worth a bit of cash. I would use an alternative, PayPal always sides with the buyer even if they're in the wrong.

Someone needs to serve PayPal some justice. Don't get me wrong, some sellers are douches too but there's a lot of douche customers also.

In my experience, if you open the claim, it usually rules in your favor whether you're the buyer or the seller. If he has already made a 'claim' via PayPal, you're going to lose the sale/money. There are only two reasons you won't have to lose your money:

Claim: Item not received (Buyer) - As long as you have proof of delivery, signed or otherwise (at least confirmation) then you're covered.

Claim: Item not as described/damaged (Buyer) - Proof of item (once returned) in operating order and/or not damaged.

Sadly, once a claim is granted to the buyer, they don't even have to return the items to the seller if they claim it was never received.

great point for sure.

Good luck with your dispute, the folks on here have given you a lot to work with, sort through what you have and put together a good case, I was scammed by a seller once, and as a buyer lost the dispute with PayPal, so it doesn't always work in the buyer's favor.

that sucks, but I think you may have a chance if you play your cards right. (i.e. trying to prove he overclocked it and voided warranty and/or damaged it).

but in case you loose the case, maybe try calling your bank and having them cut off all future paypal transfers in case they try to suck money out of your bank. (assuming you already withdrew the money from your paypal) explain to them that someone is trying to scam you and paypal may side with them. it's worth a shot.

I've been lucky and have had all good sales on eBay. except for a "new" keyboard I bought that came used. I filed a dispute, got the money back, and didn't have to ship the keyboard back. (seller had a fake address on file)

I try to fully disclose everything about my auctions so there's no confusions and loopholes for buyers to take advantage of. (speaking of which, anyone looking to buy a nice 6GB 2000MHz 8-8-7-24 kit? )
