Small claims court is an option but I don't wish to get that far. All I want is a working 5970 card. Plus, I would have to fly out to California for court. Before you know it, the cost of the card doubles....

I do believe I would have a new card already if it was not their high price card. They don't have a card to sub. It's getting to the point that they may just need to refund me which they will fight tooth and nails against.

Update

Called Asus yesterday. Nothing found again. Told them to ship it back to me so I can start legal. I was passed to customer care again. This time they are sending me a new card three months and a lot of wasted time and money latter. I should have a new retail box tomorrow.

I'm going to sell it and go with evfa. I'm so done with asus.....

Sorry to hear it, I've heard nothing but good things about Asus RMA, and they do it off of serial number which is always useful. Seems this is the thorn in the rose bush in this case.

Funny thing is... the same customer care rep took my complaint last week. The only thing that changed is my anger level and being totally fed up. I was told by a level 3 tech that my card should have been "cross shipped" (fancy way of saying exchanged) and my troubles would be over. He was reassigned when I called back to start the process... I was told by the customer care rep last week and my techs that Asus does not stock new product. In fact this was told to me for the entire three month ordeal. Funny, some how the customer care rep found a brand new retail box for me.... (Yet to be seen, should be here today...)

The key word here is "legal action". I have a solid case with three months worth of documentation. I can honestly say that my anger level has never been higher with any customer service in recent memory than with Asus. It didn't help that they still have Christmas music playing for hold music!

I called EVGA last night just to see how quick I was able to get to a tech. From the time it took me to dial to a human, well under ten minutes. I hung up an called Asus, 24 minutes. (Even tho I was told I had 1 minute to wait. Which is always the case...)

Ehh I heard a lot of horror stories about Diamond and all i can say is that, they are super helpful over the phone. Give them a call and see how much they care for their customers...

I had my 5970 flashed with MSI bios and they still replaced the card under warranty. Not to mention the card had been under water for a good 5 months, and overclocked to 1ghz/1.3ghz at 1.2 volts... lol
