Right click the network device in Device Manager and go up to the top and hit Power Management. Then uncheck the box that says "Allow the computer to turn off this device to save power".
No. Sleep mode basically shuts everything down except for the RAM (where data is stored) and USB plugs (if the options are set that way). The NIC can be active to allow the system to wake up via ethernet command, but no data is transfered while in sleep mode.
