Well, just to jump in on this, if I were to buy a smartphone (used or new) without a contract and put my SIM card in, would they be able to tell that I have a smart phone and make me get a data plan?
I don't use any data now, and have no plans to in the near future, but would like to be able to connect to wireless networks when available (I have one at home and work, and they seem to be just about everywhere anyway). On AT&T's end, my useage would not change, but not sure if the phone sends info to them so they know what I have and would require me to update.

My brother has a 3GS iPhone (don't really want it, but it would be free) and I have been thinking about it, but don't want a data plan.

nope
they can't detect it

i'm using an unlocked captivate with like a basic 2G sim card thing

its capable of using 3G<--found out by accident when I realised I was getting emails while not connected to wifi

so I just disable it within android....voila!

Cool. I don't really want an iPhone (or iAnything), so I may just look around at some of the other phones that will work on AT&T and have Wi-Fi.

Thanks

i suggest the captivate if you want a nice 4" fast android phone

or if you want to wait, the samsung infuse coming to AT&T which is basically a 1.2ghz thinner, 4.5" S-AMOLED+ version of the captivate

if you want something with future proofness

I would suggest the motorola atrix again
