sounds like ill be going down to there and explaining this problem do you think that i will need to get a new proc i guess ill water cool this one and if it dies ill get a x6

The people there seriously goofed. Thats completely unacceptable for a pc shop to do such a sloppy job. Especially on a cpu that should be loading in the mid 50's. You most likely haven't damaged you processor, but I wouldn't run it 24/7 like that or the lifespan of the processor will be severly shortened.
What clock speeds is your Phenom II x4 at right now?

stock clock stock multiplier i just reseated it funny thing i goto to wiggle the heat sink off and the cpu comes right out not correct me if im wrong but if the zif lever is down it shouldnt do that its booting up now ill see what temps are

CPUs getting yoinked out with the cooler has been a "feature" of the AM* socket forever.

As long as you don't intend on pushing your CPU 100% all the time
you're prolly ok for the time being. Definitely get a new cooler and new paste.
If you can, get some mx-4 or some shin etsu. Those are excellent pastes.
