I honestly can't fault them for putting a rootkit on their console. I understand this upsets people but it isn't like a Vaio laptop that runs an OS made by a different company and is intended for a multitude of uses. The PS3 first and foremost is a gaming console playing games licensed by Sony running a proprietary OS made by Sony that also happens to be a somewhat decent media device. The rootkit is supposed to only look for homebrew files and other "hacks." Now I understand the concern that it may see other stuff, but Sony does need to protect their software titles from piracy. Again, this isn't really like the only Audio CDs Sony released years ago that dumped a rootkit on your PC without telling you, it's a rootkit built into the OS via a firmware update of a console they make and maintain and own all the hardware and software licenses on.

(I'm sure some internal parts have different hardware manufactures, don't try to distract from the point by pointing this out, it disregards the reality of the situation.)

TLDR; Sony has the right to install any sort of copy protection they can on their product that they maintain. If it goes after other private data like video and picture files then that is a whole different story.
