[JS] Official PS3 Firmware v3.56 Has A Rootkit. - Page 4

I can understand why they are doing this. I don't have a problem as long as it leaves my pics and media alone. I am more than slightly aggravated by the stupid hackers on MW2, etc. Just yesterday alone I was matched into 10 hacked games, all of which I proceeded to have my butt kicked.

This is just getting annoying when some 12 year old can download infinite kill streaks, etc and then ruin a game for everyone because he is too immature to play the game the way its meant to be played.

Don't get me wrong, I like good modded games for fun, but when they are cheating during games which affect your ranking, etc. it is downright frustrating and I hope Sony can curb the problem of in game online hackers. I don't mind the ones for fun, but this entire situation has gone a little too far.

Needless to say, I am somewhat regretting buying my PS3 this because I know for a fact Microsoft would already have fixed this or at least issued major bans on the cheaters in question.

PS3 is a piece of hardware that runs software. I should be allowed to use the hardware as I see fit as long as it is legal.
Once again...

And are you allowed to? What does the licensing agreement say when you bought the console? The EULA is a legally binding document after all!

Sony knows that 99.9% of the people who buy that console never read more than a few lines of it.

Stealing copyrighted software titles is illegal. Regardless of that, Sony presented every person who bought a PS3 with a license agreement when they first turned the unit on that states what they allow in its use as well as their right to modify it. So I think they also have the right to prevent use of it as they see fit.

EDIT:
Woah! Hive mind, I posted this then scrolled up and saw about 3 other people bringing up the EULA.

Sony also should be aware that most people, especially those who hack and modify consoles, know that modifying software and hardware is against nearly all EULAs.

Last I checked, it's illegal to reverse engineer software in order to exploit it.

And the whole wagon thing. Yeah, those are great analogies. A tool vs. an entertainment device.

Tough luck to them! What I am getting at is that DuckieHo doesn't quite know how to differentiate his desire and opinions from actual legality.

I see the word "should" banded around a lot!

Guess I have to play devil's advocate here...

Sony is under no obligation to provide you with software updates. If you want to use their service you have to abide by their rules. You don't have to use PSN or update your console.

An analogy is meant to compare two like but unlike things to elucidate a point that becomes easy to understand given the comparison. A PS3 is the definition of a tool and I think my analogy was pretty straightforward.

And for the EULA, I suppose you all consider those 9 paragraph long disclaimers on infomercials and 100 page long contracts for MP3 players are completely fair too.
