Then when Sony detects that you're online but they cannot access the rootkit, they'll assume you hacked it.

Cant see a problem with this.

Blizzard do it with Govener on WoW to scan you HDD/RAM to see if you have bots etc running

No reason why Sony wont be allowed to do this. The EULA states you cant hack it/modify the OS and any content you can put on the PS3 legitimatly will just be saves, movies, music or pictures - not of which Sony will have a great deal of interest in when doing scans

But who can say what it checks for... What most people are missing is that Sony produces music, movies and tv. Have you ever used your PS3 to store/play any types of pirated media?

It's more that Sony are saying "We suspect you" straight out, plus it promotes that mindset which, while most people don't have much on their PS3, would be utterly horrible on a normal computer.
By installing Linux on a PS3, you are again still violating their EULA by circumventing their software security, also in their EULA, also rightfully protecting their intellectual property.

Nope. A thug off the street can win in court if you failed to live up to a written agreement that you made with him.

My goodness people, it's not like an actual person is searching through your PS3 one file at a time. Since you all love analogies, it's like a metal detector. If you have metal in your pockets, it will report that to the guard. Everything else in your pockets will remain unknown. The lesson here is, keep the metal out of your pockets. "OH BUT THEY'RE MY PANTS!"

Obviously these companies have the right to establish such terms, as someone screwing around with their cars can cost them a whole lot of money just as someone modifying Sony's (or any developer's) software can hurt them. Speaking of rental cars, almost every rental dealer also places GPS devices in their cars and know exactly where you go, with no legal concern because you agree to it when you sign for a rental.

Perfect. +1
