Who knows, maybe this chip is golden and give you 5 GHz on air. Test it first and see. If it turns out to be a dud, you can use that scratch as a excuse for a return/exchange.

Yeah I am going to RMA it. I know it is hard to tell by the pic, but when I run my fingernail across it it definitely catches. It is no shallow scratch.
dammit

edit - I have never had to RMA with newegg. Will they do it if I have used the CPU and all they have is my picture and test results? I made sure to send the picture to newegg immediately so they have a history of it before I actually use the thing.

Unless your planning on doing some hardcore overclocking, I suggest don't waste your time RMA'ing the chip. If the RMA process takes like 2 days and costs you like a $1, that fine return it, but if I were you I'd just keep it and get over it

I have a huge crack down the center of my CPU and it's fine. AMD or Intel, there isn't a handicap unless they forgot to stick a chip under that cover But if it's big and you don't feel comfortable running it, return it. Doubt they can refuse if you show them that lol. It sounds like a previously RMA's chip they sent to you.
