i accidentally killed a GTX 460 hawk with alittle too much OC play and they replaced it with no issues.

Yes, you should've returned it to NewEgg, and that was YOUR mistake.

But, it was sent to MSI, and the cards carry a 3 year warranty, so regardless, if you had sent it into them 14 days or 900 days after purchase, either way, they HAVE to honor their warranty.

The current market value of the card is $269.99 same as you paid:

I think you should get on the phone with them, and just tell them that you will wait 'till they get more cards in stock, and that you simply want a 6870 Twin Frozr II, which is what you paid for.

You should read and grasp the entire situation before you post, as this will give the impression that you are more intelligent, which is a good thing!

Yes, MSI accepted the RMA and has offered him to options in return. He didn't like the first option of the refund of market value, and I don't blame him. The second option was a open door to negotiate better terms.

In no way does this look like MSI is trying to get out of something, in fact, there hasn't been any mention of anything being faulty to begin with (by them). So, its very likely that they tested the card, and deemed that it was nominal or acceptable.

OP should've RMA'd with Newegg, as the process is so much easier and much more painless. Besides, you basically always take back "broken" items to the retailer, not the manufacturer.

This thread has really been blown out of proportion, but I guess everyone likes to hear about the latest and greatest unjustified actions made by a few individuals representing a company.

Why then can MSI not fix the card with this acceptable problem and send it back to him? Why doesn't MSI have enough stock to even cover their warranties?

Of course he should have sent it to Newegg but once he didnt and MSI accepted the RMA that became a moot point. I don't understand why that has to be constantly brought up.

I'm personally not going to stay away from MSI because I've had good experiences. Not to mention that if I took every one of these stories as the sole reason to stay away from a manufacturer I wouldnt be able to find one to buy from.

Do you REALLY believe that the place you send your cards to, is responsible for fixing them?

And honestly, I still see absolutely nothing wrong with MSI's practices in this thread, thus far. They sent you an offer, you rejected that offer....as per your right. They are leaving the negotiations open. They also haven't directly stated that your card was faulty to begin with.

This is all looking GOOD for MSI in my opinion. It seems to me like they are treating you just like they should. They accepted your RMA, when they clearly didn't have to (being the first 30 days, you are supposed to RMA with the retailer). They are also being honest and telling you that they don't have your card in stock, and are offering you a refund. Again...good of them. Their refund was too low (I agree here), so you simply reject it, and show them proof of your purchase. Bingo, you'll get the $269.99 you paid back.

Fair enough. But also note, that MSI has yet to say that his original card was broken. They just stated that they don't have any in stock to exchange it with, so they are offering a refund. They never once said his original card was faulty.
