But GeoHot's actions hardly fall in the same category as what's going on in Egypt, or Rosa Parks, or whatever bad law you want to talk about. I might have had some sympathy in this respect for his cause before, but not after the rap video...he's clearly a smartass (keyword being "smart") little punk with a sense of invulnerability and entitlement.

I am not a member of the press, and therefore don't have the press releases (plus I don't speak Japanese, the only press release I could find was in Japanese), but I have an experiment for you. Go to google, set the date from 2006-2008 (early in PS3s life before all this GeoHot stuff) and type in PS3 other OS. A bunch of sites ranging from IGN to Gamespot all say that this feature is in the newest set of features Sony has released about the PS3 or talk about how to do it after the PS3 is released. These "excited news reporters pointing out a feature" got their feature set from a press release from Sony!

Here is a statement from sony:

Sony stated, "It was fully intended that you, a PS3 owner, could play games, watch movies, view photos, listen to music, and run a full-featured Linux operating system that transforms your PS3 into a home computer."

Now I agree that they didn't advertise it on TV or in print ads they released, but to my knowledge those ads basically consisted of the PS3 melting rubicks cubes and creepy babies, not talking about a features set. Early playstation ads never really explicitly stated "It plays Playstation 3 games", but we would all be quite upset if they disabled that feature.

And Press Releases ARE advertisement. Instead of showing a feature set on T.V. or the Print media, why not release a feature set to the press and let them do the advertising for you. In California (Where Sony is looking to bring GeoHot to court), Nike vs. Kasky was ruled in 2002, and Kasky was found in favor. Nike had false advertising in a press release and were held responsible for this public commercial speech.

Hardly. If that was the case, we would be seeing a LOT more lawsuits than there already are. (God, please no.)

An announcement in a press release saying "PS3 will have an OtherOS feature" is not an advertisement. Sony won that battle in court for a reason. It's long over. No one can provide proof of a commercial nor print advertisement with OtherOS mentioned at all. Sony lived up to their promise; the PS3 had OtherOS upon release. They legally pulled it from PS3s via updates under their terms of agreement, which was also optional for everyone to download. No one at Sony force fed the update to your PS3 unless you sent it in for service.

Instructions in the user manual for how to use OtherOS is not an advertisement promoting it.

And, lastly, for those who still don't know:

Other OS was never advertised.
