Microsoft technically stopped and removed Xbox compatibility too with the exception of a handful of games. You can still play PSX games on the PS3 as well.

Microsoft has not done anything "new" or added features on Xbox 360 for the past year or two aside from ESPN. Which the PS3 has been doing practically since PSN Video has launched.
Sony has been adding DOZENS of new features on the PS3 the Xbox only wishes it could do.

It has nothing to do with the GeoHot case but is also a SUPER flawed argument.

Unfortunately, what the vast majority of these 23 pages failed to mention was absolutely the most important part of the entire "debate", legal battle or what have you.

If Geohot loses, there will be precedent for sony, apple, microsoft and any other company whom chooses you don't have the right to modify their software, to essentially take you to court.

It's in anyone's best interest, who's ever had anything jailbreaked, to support Geohot.

However fortunate or unfortunate that is, it's reality.

(That point comes from a corporate lawyer whom's phone is actually jailbreaked)

THATS WHAT IV SAID THE WHOLE TIME!!! I said that in both threads. This could set precedent for the entire modding community. From hacking firmware to modding your MS desktop. When you "buy" a console, an ipod, mp3 player, DVD player, DVDrom, Motherboard, Video card, Audio card, CPU (soon to have FW, I can see it in the future ), you are purchasing hardware with a "firmware" on it that you currently (depending on the case) can modify. If sony wins you may lose all those rights. That motherboard hack you used to get your ram/cpu support through a bios hack? Illegal, get new parts or risk being sued. That video card you bios flashed after modifying the bios (firmware)? Illegal, can't do. MP3 player you modded to play different WMA format? Roxbox is a firmware by standard: http://www.rockbox.org/ FIRMWARE, ILLEGAL. That DVD player that you hacked to get proper region support because all of your US DVDs? ILLEGAL. THATS what's going on here folks, the big picture. I swear you don't read, you just think "oh geo's an evil twirp that should burn". sa;ldjfalfjsdalj ARRR

There's just one small problem...actually two, with your post.
First, stop using the term "Jailbreak." That's used for removing restrictions from Carriers for phones.

Second, Microsoft has already set a precedant for this, just before Halo 2 was released. They updated their firmware about a month ahead of time, and once Halo 2 was released another update came. That update detected the difference in the motherboard/harddrive marriage from the previous update and banned the console from XBox Live.

God... you guys just don't cease throwing these ridiculous ideas around. The PS3's software is ABSOLUTELY NOTHING like BIOS on your motherboard. The entire purpose of buying a motherboard solo is to mix and match your hardware as you please. There will not (likely never) be any restrictions against that. Customizing your Windows operating system to look pretty is also nothing like modifying the PS3 software as Windows is shared source and PS3's software is not. And MP3 players? Really, guys, really? That's just "lol," that's the only word I can use in response to that. Rockbox is completely SEPARATE firmware from whatever your MP3 player has. On the very link you shared it clearly states that it is written from scratch. You're not MODIFYING your MP3 player's proprietary software; you're completely removing it and placing your own. If you can manage to completely remove the PS3's software and throw your own operating system, I'm sure THAT would be legal. It would probably not be legal to code the ability to read PS1/2/3 games, though as the software to do so is patented. This topic has been discussed far too many times.

But the law isn't calling it by a different name, it's calling it by firmware. Firmware is firmware by the law, which is no different. You don't understand what I'm saying. It's like saying a bicycle isn't a motor vehicle. Yes they are different, but by legal standards they fall under the same law and jurisdiction. Firmware, regardless of what it actually "is", will fall under the same jurisdiction and have to go through court. If we can get things established now it will make it harder for court cases down the road that follows these same principles. The law doesn't give a crap about the difference, if you can put it under the same lable and prove that it is "firmware" they will accept it. SO Bios = Firmware, until legally defined in court that you can't call a bios that name.
