I don't justify piracy as piracy, so all those torrent's and crap are wrong. It isn't nearly as big of a problem as people seem to think though. Unless a company is in the red on a consecutive basis, then it is a problem. I can't stand all this "loss of projected revenue". I always wonder how many people pirate it just to see if it will run on their system and then find out it can't. Or the people who download it to test for Wine/Linux and find out it won't run (I've done it, because I was sure it wouldn't run and why buy it if I'm not going to play it?). I wonder how many people download it, try it, hate it, and delete it? Those points are never answered, because you can't. You might find that less people would pirate if a demo was released, because they would either know the game play sucks and isn't for them or it won't run on their computer. How much piracy would that take off? Where is my piracy projection then?

I never stated that piracy isn't a problem - not once. However, I have never equated the unlocking of a console in order to restore the OtherOS function to be piracy - because it isn't piracy.

My point is that Sony is going after the wrong people, at least if they continue with the specious argument that OtherOS is some kind of piracy. In fact, OtherOS may need to be restored, because of anti-trust. It can be entirely argued that Sony is imposing a monopoly on their console, close coupling their software with the hardware, while excluding other innovative developments. Just like anti-trust forced MS to uncouple IE from Windows, even though MS claimed this coupling was required for "security". MS never once sued hobbyists because they chose to run Netscape, and were forced to perform various hacks and mods to their system to accomplish that task.

Of OtherOS is used for piracy - it is not the cause of the piracy. It's more like the Blu-Ray burners that Sony sells (or sells under license), which create the pirated disks in the first place. Sony has not sued themselves for creating the piracy problem through their inventions.

The only way Sony has any case is if they can prove that the mods GeoHot did were only created for the purpose of piracy, and that he was making money in the process, while doing grevious, anti-competitive harms, to Sony. Otherwise, they have no case - they just look like goons out to demonstrate that their product is a loser in the market, and that MS and Nintendo have superior products and do not go out of their way to persecute modders and hobbyists, nor do they persecute people who happen to discuss their systems in online forums.

Sony can come up with whatever draconian policies they feel are needed to combat piracy through the use of their products and attempted civil litigation, but any criminal behavior become the bailiwick of ACTUAL law enforcement.
Sony can ask you be sent to jail, but they can't make your activities criminal, at least in the United States and many other countries, through the simple use of a TOS. Actually, if look into the normal TOS these days at all, you'll find that consumer rights have shrunk to the point of not actually owning anything at all. Instead, we are being charged money to rent the ability to play games.
And it's not just Sony. It's every publisher and developer out there. IP laws are one of the new areas where people are somehow considered guilty before innocence is proven.

Essentially, I am not saying that. You are under the impression no one tried cracking the PS3 until OtherOS removed. Essentially, what I am saying is, that is simply not the truth. One person, one thousand people, doesn't matter. Since release, people have tried to crack the PS3. When OtherOS was removed, which made cracking harder, more people joined the scene. It is as simple as that, and quite understandable. I'm not sure what part of that people continue to miss.

You can't think of any others? ROFL Exactly. Uncharted, GT5, LBP, and MGS are 3 out of about a dozen + games. And to say Uncharted is over rated is garbage. Most people dont even know Uncharted exists really. What's over rated are games like Halo.

Why do people think piracy is a problem

The "victims" of piracy are still making millions of dollars every day, so what's the big deal? Should we instead choose to put even more money into some rich guy's wallet just because it's morally correct?

I will agree on the lines of legitimate numbers, people who steal (and never actually buy the software) are stealing. The problem is, they now base these numbers off torrent sites. I've put up a few questions on the legitimacy of those numbers but there are more problems. You even have the problem of some torrents sharing trackers, so the numbers on the corresponding sites is wrong.

IE: TPB and mininova both have the same torrent on different trackers. Somebody comes up and gets a torrent file that uses both trackers, now you show up as a statistic on both TPB and mininova. You can't assume now that those numbers represent two different "pirates".

Thing is, people don't think about this. All the people who go "****, 29mil pirated copies" believe that hunk of crap because they take things word for word. It's sad really, because we aren't taught to see the larger picture. It really does make me sad too, to know that people are so easily manipulated into giving up their rights. Disgust!
