Is this graphics card faulty?

Hey guys,
I recently installed an ATI 5770 into my dad's computer.(Quick bread-down of his specs): It's an Intel Core 2 Quad, 4GB RAM with Windows XP Home Edition..
He called me today telling me he had a technician in for something to do with the internet connection and said that the technician could smell something burning and opened up the case and narrowed it down to the newly installed graphics card that was the problem(it smelled).
He advised my dad to get me to check over it myself but strongly advised i returned it to the seller. I instantly knew this wouldn't be an easy task because the seller will most likely say it was a problem with the hardware i was using with it so i'm REALLY hoping it's just a small problem i didn't notice before.
One thing i will mention... I did do a bit of a no-no. When i installed the card it was about 90% of the way in and for some reason it wouldn't go fully in. My dad's computer's case is terrible and not very big and im pretty sure until after i put a rear exhaust fan in it didn't have any fans in it at all and i assumed it was something on the motherboard stopping it from going in so i just pushed it as far as it'd go and tested it anyway because it was only hanging out a tiny bit and it was only just the corner of it closest to the rear of the case sticking up a little.
It was working fine when i switched the computer on and didn't seem to smell or malfunction for the rest of the weekend using it. The technician apparently fixed the problem with it hanging out too, he said that there was a small bit of metal i didn't bend out of the way for the slot i was putting it in.

Well thanks for reading all that... The most curious thing about the whole thing is that it is rather strange for the card to be overheating when my dad only plays one game which is Maplestory and it's pretty GPU friendly being just a cartooney side-scrolling non-3D MMO.
Any suggestions?

The company does a test of the device and if it's fine you get given a $25 testing fee and it shipped back to you.... i think... theres a $25 testing fee...

Send it in for RMA and see what happens. I've never heard of this "testing fee" you speak of though. But since the card obviously isn't working, I don't see why you should put this on hold.

Overheating doesn't necessarily make thing smell burned, so yeah... I'd say it's rather unusual. It's a tough one though, I suggest you check the temperatures before sending it in for RMA. Also try running a few demanding games and see what happens.
