The fact that there was no Very High settings in DX9 mode in Crysis1 has nothing to do eith DX9 itself..
It was a plan of Crytek to make users beleive that Very High is just for DX10 (Windows Vista) only..
Now you can edit config files in CVar folder to use Very High settings in DX9 with no problem at all and you would not be able to tell the difference between Very High DX9 9Via hack) and regular Very High DX10..
I actually run both Crysis and Warhead in DX9 Very High as it performs much smoother an better than it does in DX10..
Now regarding that "source" I have to say it does not look very promising at all..
