Not even. Sony and MS are banning online accounts and hardware IDs.

GM doesn't ban my car if I change an airfilter, tires, paint, or anything else aftermarket. That's incomparable to something like piracy and homebrew.
The only comparison you could make to something like cars is if I paint my DS or PS3 to different colors - warranty voided just like my car. Completely different.

that is a SUPER POOR analogy. You buy something and modify it to do things like homebrew and piracy is completely different then changing something in your car. That's not even remotely logical in the slightest.

Ok let me break this down real simple for you fellas.

Company A sells "ThisProduct." ThisProduct can do a,b, and c tasks. ThisProduct if used to do task C can also perform task X through task C. But if task C is used to perform task X then you can no longer use TheProduct.

Even though TheProduct can be used to do task X, if you use it for that you can no longer use it even though task X doesn't mean it's something illegal.

For example HP sells "ThisComputer" that can print, display images on screen and browse the internet. But you use the internet to download movies with copy write protection. That doesn't mean that you shouldn't be able to not use the internet before because of the POTENTIAL use for abuse and illegal activities.

Just as you can POTENTIALLY be banned due to homebrew even though it's not illegal.

First of all - this has nothing to do with the car one that I pointed out.

Secondly, Nintendo's software on the DS is completely different from the software of Windows on an HP computers.
It isn't theirs to begin with. HP simply sells the hardware. The software is Microsoft's, completely proprietary from their hardware.
Nintendo's software is their software. You break into their software to use homebrew which leads to piracy, it's a WHOLE different ball game from downloading a pirated movie.

Thirdly, downloading a pirated movie doesn't involve any software or hardware modifications to the computer and the OS. What is being modified is the movie - not the computer. The movie's DRM is stripped from it (illegal) and is distributed (double illegal). Downloading it and playing it on your computer (of which isn't modified) doesn't constitute bricking your computer's hardware or software. As far as HP (hardware) and Microsoft (software) are concerned, nothing happening is technically illegal and has NOTHING to do with their roles. What is illegal is that you downloaded a movie file - which is the publisher's problem. The publisher has no ability to brick your computer.

Regardless of the POTENTIAL of homebrew and piracy - what you're doing is modifying Nintendo's software or exploiting it in some fashion. It can't be compared to downloading a movie on Windows.

I'm sure there will be a workaround. Do you think Sony anticipated people ripping a pin off of their PSP's battery EEPROM to put it in service mode and install CFW? That's why the Go has an internal battery, I think.

You completely are missing my point.

And no it's not any different from the car analogy.

Let me explain.

Ford (Nintendo) sells you a Mustang (3ds). You decide to change the air filter (firmware) to get a more desirable result (homebrew). Ford (Nintendo) then has a system check that detects genuine parts (detection of homebrew/"pirated" games). Then disables the product because you don't have the proper air filter (firmware) rendering the product useless.

What is the difference other then the words being used to describe the product?

Because - you changing an air filter doesn't mean you're breaching anything with Ford other than their warranty.
You taking a Nintendo DS, which has Nintendo software on it and modifying it which thus leads to POTENTIAL illegal activities has nothing in remote comparison to you changing an air filter on your car.

Your comparing an air filter to copyrighted and protected software - the firmware. It's completely different and your comparison is broken logically.
If I change the airfilter, does Ford give a flip? No - I just loose my warranty (does that even break a warranty?) Same thing if I change the LEDs in my PS3 or DS. I just loose the warranty - Sony or Nintendo doesn't care otherwise!

If I change the firmware, which is copyrighted/protected and non-changeable to the hardware like you purchased it, to something that Sony or Nintendo doesn't like and it has the slightest potential of piracy which leads to hundreds of different bad things to the product *ahem PSP* - Sony and Nintendo cares. Changing an airfilter is not a valid comparison.

If you're telling me that changing an airfilter will somehow lead Ford's car to become considered illegal and has the ability to lead to tons of potential losses in Ford's business because suddenly all of their cars in the entire world are compromised..... then I give up.

Let me just say that the only point you two will agree on is that the both of you are not on the same page. People against piracy-stopping tactics like these will always hate on them, and people for piracy-stopping tactics like these will always encourage them.


For everyone saying that piracy should just be ignored because of the cost (in terms of effort, resources, money, etc.), consider this analogy: If someone bigger than you was kicking your ass, you shouldn't even try to do anything about it. Just let them kick your ass, because the effort and time you put into making them not kick your ass is going to be wasted anyway.

Now, I challenge anyone to try to come up with a solution for the person who is getting their assed kick to stop getting his/her ass kicked.
