Eula is not law. If you break the a EULA you are subject to CIVIL sanctions/actions/etc if you are sued.

However some of these actions may be against laws, such as copyright laws etc.

So no, EULA is not LAW. But taking certain actions to break EULA may be illegal. For example:

1) Selling a copy-righted disc w/o consent of owner. Illegal and against EULA.

2) Opening up PS3 and hacking firmware by yourself. Against EULA. Yes, against law, no.

Things can get complicated if you go beyond one person though. You can get hit with conspiracy. The amount of evidence needed to convict in the "planning stage" of the crime decreases once you move past 1 person. For example, you have a map of a bank. By yourself, not really enough. Get 2 people? If might be enough to send you to jail.

Tieing conspiracy in... If you get other people involved to hack it wouldn't be too hard to perceive intent as copyright infringement.
