[ArsTech] PS3 jailbreaker claims Sony is misleading the courts - Page 4

^ to discuss about the post above..

Your bringing up situations that happen in that specific place,
this is more of me committing a crime in FL and upload a video of it and because the server is in California, I get tried over there. This wouldn't happen of course, the case would occur where it was committed but in the case of geohot, they bring up reasons which makes no sense.

It's just because twitter and youtube and paypal is based in/at California but that would mean if I threaten to do something criminal on twitter, I'll be in court in California regardless of where I commit the crime.

I know both paragraphs are repeats of the same overall idea. Sony wants to keep it there because it has influence and as much as most might say money isn't involved, I beg to differ....

I know what you mean; yes, I would be physically performing a crime within that particular state. It is difficult to reason that internet crime should be treated differently than physical crimes. Identity theft, child pornography, hacking into government files, etc. are all pretty serious crimes.

When someone somehow stole my sister's information and bought a load of crap at a Best Buy in California, my sister had to call up the police department in California to file the police report and start an investigation.

By the logic that you're comparing physical crimes to digital crimes with, that would mean that if someone hacks into my computer from New York using a proxy server in California and retrieves my credit card information to purchase a bunch of goods, they would be treated differently than if they obtained my information by some other means, such as stealing my credit card out of my wallet at a store here in Florida.

I'm not sure if I drew that out well enough, but I guess my point is it's questionable to treat digital crimes any differently from physical crimes, especially considering the foreseeable future where physical robbery is a joke and digital crimes are the new thing. Geo distributed his hack worldwide. If Sony can prove that his hack reached a large population within California, they have a case in California.

Geo's little trick reached across the entire planet within several minutes. Sony damn well has the right to try him in any court they please within the U.S. so long as they are established in that state.
Lets assume you murdered my family at my home in New York with a bomb, and this bomb was activated by a phone call you made from Texas. Where should the court take place? You committed the act in Texas, but the murder took place in New York.

seriously? you guys are blurring the lines here of criminal and civil law...

yes he committed a crime, but not one against the people of the united states...it is why he isn't facing prison time, and will only be responsible to liable damages...he wont even be found "guilty", either liable or non liable.

if you don't pay your rent and you live in new jersey, and the company that owns the building is based in california, where would you tried at to for the eviction and the loss profit? would you be taken to california and be tried there? no, they would file the grievance with a court system with in your city/count/state, in the accordance with state law...how is this any different to be honest as this is a civil matter, not a criminal one?

A big corporation suing a single individual over copyright related things that isn't misleading the court happens?! WOW

Naw, seriously, they all mislead the judges. They play on the judge's lack of familiarity with computers and internet culture to bend the law their way. Wouldn't surprize me a damn bit of Sony was doing a bit of the same thing on paticularly flexible judges in Cali and wants to hedge their bets by bringing it before those judges.
