EVGA has said that overclocking is covered as long as there isn't any physical damage to the card.

So if I screw the VRM's, eVGA screws me...
How does the Hydro copper OC?
Stock 630 Mhz Core, Linus got it past the 580 speeds on air !!

I'm pretty sure that by physical damage they mean if you somehow damage it trying to disassemble it or otherwise, not if a circuit or VRM manages to fry itself when you are trying to stress test it. Also I'm pretty sure they frown upon people flashing custom bioses.
