A game on the market can easily have the main .apk under the size limit, and download however much data it needs afterwards. Spectral Souls is a great example of this, it downloads something like 650mb of game data. I've never purchased a Gameloft game, so I can't say if they already do this, but I have seen the pirated versions all come with a folder of "download data" to throw on the SD card, which would make me think that they're doing the same thing.
As for the no DRM thing, that's ridiculous, several games/apps on the android market have DRM. Spectral Souls is again a great example, as it's drm has yet to be cracked.
The reason Gameloft doesn't want to be on the Android Market? It's the ~32% cut Google takes, imo.
