It appears you may have missed the point.
'AM3b' supports backwards compatibility with standard AM3 CPU's and will function on a 8xx chipset. Why not simply put an AM3b socket on your board if that is the case? You extend the longevity of the enthusiast sector who bought your board, of which they will likely do again based on your 'innovative' approach.

My only question is what was in place to prevent them from advertising it as AM3+..

Sorry, what I meant was how much will BD suffer on the AM3 socket. BD was solely developed for AM3+, per AMD. Now if it physically fits in a AM3 socket is still up in the air, but Asus thinks and says it will.
Now, if AMD uprates the current Phenom II cpus to AM3+ standards, and keep backwards compatibility with AM3 mobos then that is a win/win for the older mobo owners.
Gigabyte is releasing mobos with the AM3b (AM3+) socket as revisions to the current mobo line up. Asus made the bold claim that all they needed was a "BIOS update" and presto: You can run BD on your older AM3 mobo. They never said anything about BD in their press release but some here on OCN ran with it. Some have even said that BD will work with the Asus bios 3012. But if Asus all of a sudden clams up and says that they would violate the NDA, um I think it is a bit late now for that. They have started a very confusing, unclear situation that nobody knows exactly what is going on.

If I remember correctly, JF-AMD said that AMD was not condoning any of this BIOS-updating. So even if I had a CH IV F/E, I'd still bump it up.

If you were going to buy a bulldozer and drop it on a AM3 board, even with a BIOS update, it would be silly not to expect some compatibility issues because they never claimed full compatibility with the AM3 boards, so why would anyone try to pin them down on the percentage of compatibility if there was never claim of full compatibility. now with that being said it's just common sense to buy an AM3+ board from the start.
