[ArsTech] Sony v. Hotz: mismatched serial numbers and sealed manuals

Hotz's attorneys claim that he couldn't have known that Sony Computer Entertainment of America existed, since the manuals for his new PlayStation 3 remained sealed and the box only mentions Japan.

The documents also address that pesky PlayStation Network account that Sony claims Hotz created, and it may prove hard to find out who that account actually belonged to, especially when both Sony and Hotz are claiming the system in question has a different serial number.

If you read the article that's not what's supposed to stand out, although I also caught that. Lol.

It has to do with the last four digits and how they don't match what Sony claims is his system.

I think this has to be one of the dumbest legal cases in recent history, aside from Apple suing Amazon for rights to "appstore" which isn't even spelled the same way.

So, what have we learnt here today? If you don't know about something, it no longer exists That's why when I go do something illegal, and nobody sees me, what I did no longer exists...

This case is different from a standard crime...I think that Sony has to prove his intent was malicious, and if he "really" didn't know there was an American Sony, I think that helps that argument...but this is a guess, I don't really know the legal specifics of this case or if what I said is true. Just what it sounds like.

It may be. But what his lawyer is trying to say is that the box should also mention that Sony also has a HQ in the States. As you know international laws are a gray area, especially when it relates to software infringements. Kind of like the FBI. They can screw you while you're in the states but step into another country and they have to rely on extradition and possibly even the CIA to get the accused back into their jurisdiction.

So if Sony is claiming that SCEA exists (which it does) GeoHotz' lawyer is trying to say how can you prove that SCEA owns the rights to this product when it doesn't even mention it anywhere.

GeoHotz lawyer seems like he's trying to get this pushed into international courts due to Sony being based in Japan. Things will get messy then, and quick.

I'm probably going wrong somewhere here but it seems like it could be a valid argument.
