He didn't sign up to psn! There maybe a eula I dont know what that entails, but whos to say he didnt crack past the EULA? untill they can prove he signed up for anything then they have no case. They are trying to prove he bought a ps3 with no receipt and they have an ip address linked to a psn
account near his home.

If you have proof he has a psn account please contact Sony, they could use it.

There is no proof he signed up for a PSN account,

As the article stated, if they had proof, it would have been in the courts already.

They have no solid evidence to bring Hotz down in the case.

The jurisdiction is important because Sony doesn't have a case. There is no way they can prove Hotz acted with malicious intent.

Sony is acting like he hacked into their headquarters and stole sensitive data. All the defense has to argue is that it was done to expose the flaw and potentially to restore lost functionality (Other OS)

TOS and EULA aren't law. The worst Sony can do if you violate the TOS is ban your console from PSN.

Not at all.... the lawyer is trying to have the case tried in a state where the law favors his client. Just like how Sony is trying to have the case tried in a state that favors them.

Federal/State law over rule ToS and EULA. If you break a ToS/EULA and the violation is not a criminal offense, the company can only terminate your service.

Not to mention that SCEA isn't mentioned in the EULA (of the SDK, and presumably the PS3's initial setup), only SCE (Jpn based).

The only mention of SCEA is in the manual, which Hotz never read. So he could not of known about SCEA having any involvement in the PS3. And they don't, they're mainly in the software and games and aren't even a subsidiary of SCE.
