2600K Failed IBT

This is really strange, recently my brand new 2600k started failing IBT when using the max settings even at stock clock / voltage but has no problem running prime for 13 hours. The problem started after I started to game. Couple days later it will fail IBT on the start of the third run, as soon as the second one finishes it will fail.

8GB Patriot 1866mhz 1.65v ram 2 dimms
560TI msi twin frzr (not that it probably matters but just incase)

Is it a bad cpu? i mean i am typing from it currently seems to be a bit slower though when opening apps oh forgot to mention my load temps don't even break 60C on stock voltage and at 4.5ghz @ 1.320vcore never break 73C. Please help guys I have no idea whats wrong, I still have a couple days to return it if its bad. Thanks!

IBT/LinX can be extremely strange at some settings. There were people who were picking a manual number of threads, when the i7 920 first came out, and having IBT fail at the EXACT Same spot---every time--

BTW, did you get the latest linpack binaries from the Intel website? You have to throw in the binary files into the correct LinX folderk, and if you use Intel Burn Test (agentgod), you need to rename the exe files as the names dont match (but the 32 and 64 bit exe's still do the exact same thing).

Make sure you're using the latest binaries.

I did download the latest linpack and remaned it correctly, Everything worked and completed these tests before i started gaming. I was getting around 110 - 115 gflops when it worked correctly now i only get 100 - 105 on those 2 tests that pass. However I got a new problem if you can call it that i hit clr_cmos hoping something was messed up and now my cpu runs at the stock max ratio 24/7 it does not go down which is really weird!

might be your motherboard if its spitting out CMOS errors

There are no errors i cleared the cmos hoping someone messed around in the bios set something that shouldn't have been set. Now the cpu runs at full multi all the time whatever its set to its not BSODing on me its just failing Intel Burn Test and now this full multi use all the time problem. I'm almost pretty sure this is a bad cpu

Do you know what bios version you're using? Some of the earlier ones had some very strange problems.

Bios 1502 I believe. This is really weird. I stayed under 1.35vcore on my oc my temps were great and out of no where this happens and now it won't even work with stock settings and its not even a month old yet.

For the IBT error i'd put money on it being a rounding error. It's always going to happen, even with stock CPUs.

But the fact that your CPU is stuck at full multi all the time indicates that turbo or power-saving is turned on. Did you switch any of those useless sliders on the motherboard?

No its all off, I've tripple checked. I just find it weird to work amazing the first week and fly through ibt and now it can't even complete 2 runs and in those 2 runs I have a smaller gflop then I use to when it would complete the test. Now it fails at even the standard level and it passed it fine when I opened this thread. I'm really lost =\\
