I think it all depends on how far they've gotten in correlating IMEI numbers to phone manufacturers and types (that's how they're doing it now, is by reading the IMEI number and determining phone type, and then adding a data plan if it's a smartphone). But their intention is to enforce data plans on all smartphones being used on their network (minus prepaid/pay-as-you-go plans, of course). The iPhone was just the easiest place to start.
So then this begs the question. Are you able to have your phone lie to AT&T and give them a false/made-up IMEI number?

I'm on one of those old plans, +15 for data. I was worried because I just got the wife a $99 unlocked Streak, that when I added the data plan it would be a bike hike but it was still locked at the 15 a month. Small victory I guess.

No idea. An IMEI number is a hardware identifier number, similar to a MAC address. Guess you could spoof the number that's reported if you had the hardware/phone OS knowledge, and knew what to edit without bricking a phone. To my knowledge, I don't know of anyone that's done this.

No the "dumbphone" medianet pricing is still $15 for unlimited. You're thinking of the DataPlus/Pro plans for their smartphones which is $15/200mb and $25 for 2GB

Any smartphone that isn't sold by AT&T can use the $15 dumbphone data plan (with a few exceptions, the Nexus One comes to mind)

Thanks for the all the help, those who posted, I've limited my choices to the HTC HD2 and the HTC Touch Pro2. Going to watch ebay for a few days and see what I can snag.

It's also 1/4th the price of the HD2. Which is the big thing it has going for it right now in my book

TP2 is a pretty good phone. The main issue I have heard about it is the wifi/bluetooth tethering fails, but since you do not want data plan should work nicely. There are tons of custom roms for it as well that help make it run better than stock.
What is nice about HD2 is that you can run android on it also. As far as that goes you would have to find a rom that you can either bypass the setup or using wifi. They are there, just got to find them.

I really like my HD2, running a custom nexusHD/Gingerbread rom on it, and no complaints so far. In standby battery only uses 3-5ma.

Who is your carrier?

And I think I'm going to cave and get a Tilt 2 just so I can take advantage of the 3G.
