XFX warranty denial?

i have bought a 2nd hand gpu from XFX and it seems it has some defects so i wanted to RMA it. the card was originally purchased @ 07.05.2009.

i got in contact with the XFX support and when i asked if i can RMA it after some problem shooting i got this answer:

then i asked why it exceeded the warranty because it isnt 2years old yet and i got this answer:

i searched everywhere for something in the warranty description that mentions that the warranty starts the day the distributor buys the card but couldn't find anything about it and find it really disturbing because i never heard that a warranty works like that.

whats going on there? are they allowed to do that? is that legal to set the warranty to the date the distributor bought the card and not the end user?

Yes. It's legal.

Technically speaking, it's the warranty on the CARD, not on the term of length from when a buyer purchases it from some arbitrary seller. :-/

I'm trying to figure out why you didn't register it for the lifetime warranty, or is this not a GPU that has that sort of warranty?

as mentioned its a 2nd hand and the previous owner has not registered it... i did register it when i recieved it but i dont think that counts for the lifetime warranty, does it? and is there a special method to register for lifetime or is it enough to register the product?

i honestly never heard of such warranty terms before. also with the new zotac it says clearly in the warranty that it starts the date when i bought it.

i meant its really ridiculous because a card could like be in store for about a year and when you buy it (with a 2 year warranty) you only get 1 year of warranty? how messed up is that...

Doesn't matter if it's second hand, XFX allows their graphics cards to be sold to another individual and the warranty will be valid for that person just as it was for the original buyer.

If you registered the lifetime warranty, then you have it. If you didn't, then you don't.

Keep on pushing the issue, This is the same thing that happened to me with gigabyte a few years ago. They still have to honor the original warranty. If any thing report it to the BBB and the attorney generals office.

His location indicates he is not in the US so XFX warranty might be different. Honestly this doesn't surprise me XFX has never been good with warranties.

He's in the EU, different warranties. He bought it from a distributor which overs the warranty for the first two years, before transferring to XFX. There's no 2nd owner lifetime iirc with non-US warranties.
