Take the board use it still ....(which it can most likely still be used
keep using it till something new comes out then make a nice little video to send to evga and shoot the board, dent it up and dress yourself as an EVGA employee and show them what they do mean approach but always handy to piss them off....at some level

I doubt anything will come out of taking them to court.

They would probably make up some BS excuse about it.

I saw a couple of threads here about EVGA pulling stuff like this and most of them ended up having to pay for the replacement.

I had issues with the PCI slot 2 times, an issue with the onboard audio and another issue with it failing to boot up after a week of use.

It's a very faulty-prone model.

I think what really matters here is that you agreed that you made those two marks in the first two pictures and regardless of the other scratches your RMA would still have been denied.

Cut your losses and get a better 1366 board. My brother was able to find a RIIE on ebay for $150 shipped and that will run circles around your E758.

Court? Over a motherboard? Even if he wins the legal fees would be more than the board is worth... Never mind that the court date would take the better part of a year to arrive.
