Issue with new Biostar MoBo TA870U3+

The problem:
Install all hardware and windows 7 64bit, and things seemed ok for a day. Things started acting up and then the ethernet card takes a dump. Windows will still see it but not recognize it as a 100Mb connection but rather a 10Mb connection. Speed tests show me at 9-10Mb down and consistently fail on the upload speed test. Have ripped and reinstalled the nic drivers, checked for updates, forced the nic to use 100Mb/full duplex (it just reverts back to "auto" and reads 10). Also, when I totally remove the drivers from the machine and reboot, windows fails to recognize any unknown hardware, it's as if it wasn't there. The MoBo disk will let me reinstall the drivers, then windows will see the nic and then right back to 10Mbs and no (minimal) upload. However I'm not seeing any lost packets when I ping out...

I've plugged my laptop into the same cable in the same port on the router and she screams. 40Mb down and 4Mb up.

This is the second motherboard of the same make and model; from the same local retailer; that I've recieved in 3 days (returned previous one because of the issue), and the symptoms are nearly identical. Am I wrong to think that theres an issue with the nic on-board the MoBo, maybe a bad batch or something? I've tried multiple OS installs with both motherboards. If I return this one, should I consider another model? I do like the color scheme, as everything in the build is red/black, but at this point I'd just as soon have a working rig over a matching one...

My system is as follows:
Motherboard: TA870U3+
CPU: AMD Phenom II X6 1090T
GPU: Radeon HD6850
Memory: 8Gig (2x4) Patriot DDR3
HDD: Seagate 2TB Sata3
Case: CM Scout

If I've left out any details or anyone has any idea please let me know. If I can't get this figured out I'm probably going to pack it all back up again and bring it back (really don't want to tear the rig down again)...

Thanks in advance everyone, you've got an awesome forum here...

Mike

Yes. The mobo is bad. So return it. I would also calmly try to trade it for another mobo for no extra cost for a better one. Personaly I don't like biostar stuff. Too much failing stuff.
