At least in Spain, warranty for hardware is a 2 year period, and they're legally forced to give you one with at least the same performance.

So yeah, he is supposed to get an HD5870 or better, not worse.

This seems right in my mind and makes sense with the 6850 offer. 5870's are 200 Canadian now, so you should get a 6870 at the very least.

WRONG

If a card breaks within 6 months, They replace it.

If a card breaks after 12 months, They send it off for repair.

If the card is not repairable they will try to replace like-for-like.

If they can't replace like-for-like they'll offer a replacement.

That replacement is determined by the current market value of the broken card.

Just because Vendors have been known to replace weaker cards with more powerful ones doesn't meen EVERY retailer has to.

A 6850 is a newer card and costs roughly the same price as used 5870.

The retailer could in all fairness just tell the OP to deal with the cards vendor directly as retailers only legally have to deal with RMA's for the first 12 months.

1) It burned itself. It SHOULD BE MADE to withstand the extreme burn in mode. It loads 100% of ALL the card. It should stand that.
2) Who cares? it is in warranty.
3) So, they should give me the equivalent (as Sapphire states in their TOS)
4) It is about 25-30% slower in most cases.
5) They SHOULD as they stated in their TOS.
6) It wouldn't be equivalent, so wrong for the 3rd time.


Ah, I didn't say that the card is not more than 12 months old. It was seven in fact. From August'10.

No, you're wrong, it is illegal to provide a weaker card when RMA'ing it

Not sure about the US, but I am telling you it is NOT legal in Spain.

Sure, they will send it to repair after 12 months, but if they can't repair it, they're legally forced to give him a replacement with at least the same specs or better, but never weaker.

Honestly, we could argue as much as we want, but that's the law in Spain, and they're legally forced to offer him another HD5870 or better, but nothing worse.

Now... It could be different in other countries, can't tell

If it's only 7 months old, then you do not have to send the card to the distributor, you can get a straight replacement according to the law.

Go talk with the store you bought it from and ask them for another HD5870 or better, but not a joke of an HD6850.

Spanish consumer law.

Reading that you have no rights to ask for anything above a 5870.

A 6850 is a fair swap, If you don't like it request to have the card shipped back to you and deal with the cards vendor directly.

I don't ask for anything but a card like mine, in BN state as they claim. If they can't provide it, I ask what they say. The immediately superior card that's closer in performance. In this case, a HD6950 1GB/2GB, what they can give. And that's what SAPPHIRE'S TOS say.

And dude, get your facts striaght, cos you're obviously fail-trolling. A HD6850 is WAY slower that a HD5870.
